STATEMENT ON BEHALF COACH KEVIN BROADUS FROM LINDA KENNEY BADEN, ESQ.

[New York, NY] [October 18, 2010] – Today Linda Kenney Baden, Esq. issued the
following statement on behalf of her client, Coach Kevin Broadus:
“We have received notice the National Collegiate Athletic Association (NCAA) has
closed its investigation of the men’s basketball program of SUNY-Binghamton that
included allegations involving Coach Kevin Broadus. Since the investigation is closed it
is time for SUNY – Binghamton to restore Coach Kevin Broadus’s dignity and reputation.
Chancellor Zimpher spent nearly 1 million dollars, half of it from taxpayer funds on an
audit riddled with innuendo that caused enormous damage to Coach Broadus.
Perhaps instead of seeking raises for her close advisors and renovating her offices
reportedly for millions of dollars, she should focus on treating all her employees
equally”.

Today my Attorney sent a letter to the EEOC asking them to take over my case now that the NYDHR has granted our request to administratively dismiss the dually filed action.

Yesterday morning ABC12 WJRT-TV printed an article on their website that my attorneys and I believe contained a libelous statement-that the ‘audit’ had concluded that I committed two specific wrongdoings. We orally asked for a retraction and the ABC affiliate said it relied on old Associated Press (AP) reports in reprinting the specific statement that is false. My attorneys have sent a letter asking for a retraction from ABC12 and to the Associated Press- to request that they immediately correct same.

The SUNY- Research Foundation has claimed that because they are a private tax-exempt entity they do not have to open up their records about the funding of the near $1 million dollar audit performed by a private law firm involving SUNY- Binghamton. My attorney has appealed their denial on the basis the transparency not secrecy should prevail.

The SUNY Research Foundation has denied giving the public documents in the Broadus matter under the Freedom of Information law. Claims they are Private. Claim they do not have to RESPOND to Broadus’ FOIL request for documents related to Zimpher’s engagement of them in matters pertaining to the Binghamton and myself. So much from transparency in government- instead we now have opaqueness and secrecy

My attorney asked the NY STATE DHR in the 56 page response I filed to administratively dismiss my complaint with DHR so that we can let the Federal EEOC take over the investigation and then file a Title 7 claim in Federal court after the required time period has run
