Chancellor Nancy Zimpher last year announced Emmanuel ‘TIKI’ Mayben to receive her award for academic excellence

Posted: April 30th, 2010 | Author: | Filed under: Articles | No Comments »

See SUNY press release where it was said in part:
“State University of New York Chancellor Nancy L. Zimpher today announced the recipients of the 2008-09 Chancellor’s Scholar Athlete Award, which recognizes academic excellence and athletic achievement at the National Collegiate Athletic Association Division I, Division III and NJCAA levels.
‘It is an honor for me to recognize these students not simply for their distinguished athletic accomplishments, but for their substantial academic achievements.  These exemplary student athletes are winners on the field, and more importantly in SUNY classrooms across New York.’
Scholar athletes are nominated by campus representatives and are reviewed and approved by SUNY System Administration and athletic directors representing SUNY Division I programs, Region 3 and Region 15 of the NJCCA, the State University of New York Athletic Conference and from independent SUNY institutions participating in Division III programs.
In order for a student to be considered, their athletic accomplishments must be recognized at the conference level or by the NCAA.”
With an average GPA of 3.69, these student-athletes have combined exceptional accomplishments in the classroom with superior performance in the athletic arena.

NEW - On April 18, 2010 I received my Annual Performance Evaluation

Posted: April 29th, 2010 | Author: | Filed under: Articles, Legal Docs | No Comments »

> Evaluative comments for Kevin Broadus provided by James NORRIS APRIL 28, 2010

“Provide consultation to athletic department (sic) and men’s basketball program as needed and perform other athletics related duties as assigned. Kevin performed the above duties in a satisfactory manner. He actively participated in the development of the basketball operations plan and submitted feedback and materials in a timely manner. Additionally, Kevin met periodically with me to discuss the future of our men’s basketball program and specifically such items as scheduling and budgeting. Short term objectives; provide support to upcoming audit of men’s basketball program in terms of providing information, meeting with individuals and cooperating with any inquiries Kevin performed the above short term objectives in a satisfactory manner.”

> Evaluative comments for Kevin Broadus provided by Joel Thirer 4/21/10

“Kevin came off of the most successful season in school history, after which his contract was extended, He operated within the parameters of his budget allocation. He put together a competitive schedule for the 2009-10 season. He successfully recruited competitive student athletes who would, under normal circumstances, have allowed Binghamton to remain among the top’ programs in the America East Conference. Four of his team members graduated (Jaan Montgomery, Reggie Fuller, Duane Jackson and Sean Watson). At the conclusion of summer semester, the retuning players had a good overall composite grade point average (2.55, I think). He was committed to the young men in his charge attaining an education to prepare them for their future lives, and to seeing them graduate. Kevin was easy to work with and did everything he was asked to do. He dealt with behavioral issues appropriately, and took proportionate punitive action when warranted.”

“Rochester Man To Be Freed 18 Years After Wrongful Murder Conviction; DNA and Confession Lead to Actual Perpetrator” – The Innocence Project

Posted: April 28th, 2010 | Author: | Filed under: Articles | No Comments »

The Innocence Project just freed an man in NY yesterday. He was convicted on a false confession . The IP says that 25 per cent of their cases  have false confessions in them. It is well known young people are very susceptible  to confess to a crime because of the pressure they feel by police. This is what happened in part in the Central Park wilding case in NYC some years back. We all need to be aware of this  no matter who we are.

NEW - Coach Kevin Broadus reply report to NYDHR and EEOC

Posted: April 26th, 2010 | Author: | Filed under: Legal Docs | No Comments »

On April 26, 2010 I filed through my attorney a 66 page document with the Division of Human Rights and the EEOC.

It is titled “Reply Report of Coach Kevin Broadus to the Submission of the Respondents – including the State University of New York and Chancellor Nancy Zimpher and Various Others.” Any issue of workplace discrimination is a matter of acute public concern. I hope you will all read this responsive report and engage in productive public discourse about the issue.

I. INTRODUCTION

a. A Public Lynching.

In 1991, then Judge Clarence Thomas told then Senator Joseph Biden that gossip, lies, sleaze and dirt had been displayed, leaked and fostered against him creating a travesty of justice. Justice Thomas’ words are an equally appropriate response now to the eight-month campaign against Coach Kevin Broadus that culminated in the response filed to this agency by the Zimpher headed SUNY system to his charges of racial discrimination and disparate impact:

No job is worth it. I’m nor here for that. I’m here for my name, my family, my life and my integrity. I think something is dreadfully wrong with this country when any person, any person in this free country would be subjected to this …. This is a circus. It’s a national disgrace. And from my standpoint as a black American, as far as I’m concerned, it is a high-tech lynching for uppity blacks who in any way deign to think for themselves, to do for themselves, to have different ideas, and it is a message that unless you kowtow to an old order, this is what will happen to you. You will be lynched destroyed, caricatured … rather than hung from a tree. (emphasis supplied)[1]

Not since the hearing on the nomination of Judge Clarence Thomas has a public body and the official who heads it, created, fostered, and embraced such hype of scandal, by commissioning an unusual, a near million dollar incomplete ‘audit’ disregard by avoiding public bid channels, and relying on media reports and television appearances of reporters, in an attempt to justify the employment actions against the only African-American Division I head coach in the SUNY system.

Posted: April 25th, 2010 | Author: | Filed under: Legal Docs | No Comments »

On April 16, the school newspaper- the Pipe Dream- adopted as their traditional editorial view an April Fool’s mockery of my  EEO claim which was tweeted and reproduced nationwide. Here is our response in its entirety to the recent editorial that ran in the Pipe Dream. Hopefully next time they will decide to present both sides in their reporting and commentary.”
